The Fair Credit Reporting Act

The FCRA is a federal law that gives you powerful rights over your credit information. Every American is protected — most people just don't know it.

📜 WHAT IS THE FCRA?

Enacted in 1970, the Fair Credit Reporting Act regulates how consumer credit information is collected, shared, and used.

It applies to Consumer Reporting Agencies (CRAs) — including the three major bureaus: Equifax, Experian, and TransUnion. It also governs lenders, employers, landlords, and anyone else who pulls your credit report. The FCRA is enforced by the Federal Trade Commission (FTC) and the Consumer Financial Protection Bureau (CFPB).

⚖️ YOUR 8 KEY RIGHTS UNDER THE FCRA

Right 1

Right to Access Your Credit Report

You are entitled to one free credit report every 12 months from each of the three major bureaus via AnnualCreditReport.com. You also have the right to your report if you've been denied credit, employment, or housing based on it.

Right 2

Right to Dispute Inaccurate Information

If you find errors on your report — wrong balances, accounts that aren't yours, incorrect late payments — you have the right to dispute them. The bureau must investigate within 30 days and correct or remove inaccurate items.

Right 3

Right to Have Errors Corrected

If a dispute is verified, the bureau must correct or delete the inaccurate information. If the furnisher (lender) cannot verify the item, it must be removed — even if it was originally accurate.

Right 4

Right to Know Who Pulled Your Report

Your credit report includes an "inquiries" section listing every entity that accessed your report. You have the right to know who has been reviewing your credit history and when.

Right 5

Right to Outdated Information Being Removed

Most negative information — late payments, collections, charge-offs — must be removed after 7 years. Bankruptcies can stay up to 10 years. After that, bureaus are legally required to delete it.

Right 6

Right to Opt Out of Pre-Screened Offers

Lenders use your credit data to send pre-approved offers. You have the right to opt out of these at OptOutPrescreen.com — permanently or for 5 years — limiting who can access your information for marketing.

Right 7

Right to Place a Security Freeze

You can freeze your credit at all three bureaus for free, preventing new accounts from being opened in your name. This is one of the strongest tools against identity theft. Freezes can be lifted at any time.

Right 8

Right to Sue for Violations

If a bureau, lender, or employer willfully violates the FCRA, you can sue them in federal court. You may be entitled to actual damages, statutory damages of $100–$1,000 per violation, punitive damages, and attorney's fees.

📋 HOW TO FILE A DISPUTE — STEP BY STEP

Step 1

Get your free credit reports from AnnualCreditReport.com — review all three bureaus.

Step 2

Identify errors: wrong personal info, accounts you don't recognize, incorrect balances or payment history, duplicate accounts, or outdated negative items.

Step 3

Write a dispute letter to the bureau(s) reporting the error. Include your name, address, account number, a clear description of the error, and why it's wrong.

Step 4

Attach supporting documents — bank statements, payment confirmations, identity documents — as evidence.

Step 5

Send via certified mail with return receipt so you have proof of delivery and the date.

Step 6

The bureau has 30 days to investigate. They must contact the furnisher (lender) to verify the information.

Step 7

You will receive written results. If the dispute is successful, the item is corrected or removed. If not, you can request a "statement of dispute" be added to your file.
